Recovery Certificates Explained: From DRT Order to Execution

An order from the Debts Recovery Tribunal allowing an Original Application does not by itself hand over any money. It results in a recovery certificate, and turning that certificate into actual recovery is a distinct process with its own procedure.

What a Recovery Certificate Is

Once the DRT determines the amount due, it issues a recovery certificate specifying the sum payable by the defendant. This certificate is then forwarded to the Recovery Officer attached to the Tribunal for execution.

The Role of the Recovery Officer

The Recovery Officer has wide powers modelled on the process for recovery of arrears of land revenue, including attachment and sale of the defendant's movable and immovable property, appointment of a receiver, and, in appropriate cases, arrest and detention of the defendant.

Attachment and Sale of Assets

Where the defendant has identifiable assets, the Recovery Officer can attach and sell them to satisfy the certificate. This is a separate proceeding from the underlying suit and follows its own procedural rules on notice, valuation, and sale.

Where SARFAESI and Recovery Certificates Intersect

Where security exists, proceeds from a SARFAESI sale are first applied against the dues; a recovery certificate is typically pursued for any shortfall between what the secured asset realised and the total amount owed, or in cases where no adequate security exists at all.

Realistic Expectations

Execution can take time, particularly where the defendant has no easily attachable assets or resists cooperation. Institutions that track recovery certificates actively, rather than treating the DRT order as the end point, recover materially more than those that let execution proceedings lapse into inactivity.
