Section 14 Applications: Getting the Magistrate's Help to Take Possession

Not every SARFAESI possession goes smoothly. Where a borrower or occupant resists handing over a secured asset, the secured creditor cannot simply take possession by force; the law requires an application under Section 14 to the District Magistrate or Chief Metropolitan Magistrate, who alone can authorise assistance in taking possession.

When a Section 14 Application Is Needed

It becomes necessary whenever possession, symbolic or physical, is likely to be resisted, or where the creditor anticipates obstruction. Attempting possession without this authorisation where resistance was foreseeable is a common and serious procedural error.

What the Application Must Show

The application needs to demonstrate that the statutory conditions for enforcement have been satisfied, that the Section 13(2) notice was properly issued and the 60-day period has lapsed, and that possession is now due under Section 13(4).

The Magistrate's Role

Once satisfied, the Magistrate can direct the Chief Metropolitan Magistrate or District Magistrate's own officers, and where required the police, to assist in securing possession, including breaking open a locked premises where necessary. This authority is what makes physical possession enforceable in practice, not merely on paper.

Common Delays

Section 14 applications can face delay through incomplete documentation, disputes over whether the account genuinely qualifies as an NPA, or the presence of tenants or third parties claiming independent rights over the property. Anticipating these issues before filing, rather than after an objection is raised, keeps the process on track.

After the Order

Possession taken under a Section 14 order should be carefully documented, an inventory where relevant, photographs, and a possession report, since the manner in which possession was executed can itself become a point of challenge later.
